This policy explains when you can bury a person on private land instead of a cemetery. It also explains the rules and how the Council decides applications.

Who this applies to

This applies if you want to bury someone (not cremated) on private land in the Yankalilla Council area. It includes landowners, families, and funeral directors.

You do not need approval to scatter ashes on private land.

Key Rules

You must have permission from the landowner
The location must be suitable and safe
The burial must not affect water, environment, or nearby areas
The burial site must be recorded so it is not disturbed later
You may lose access if the land is sold in the future

Simple Definitions

  • Bodily remains — a human body that has not been cremated.
  • Cremated remains — ashes after cremation.
  • Interment — burial in the ground.
  • Natural burial — no chemicals and biodegradable coffin or shroud.

Important Legal Rules

  • Burial must follow State laws
  • Grave must be at least 1 metre deep
  • Grave must be at least 20 metres from buildings and water sources
  • The burial location must be recorded (address, title, GPS)

Applying for Approval

You must apply to Council before any burial takes place. It is best to apply well in advance. Late applications may delay burial. Your application needs:

  • Completed application form
  • Proof of who is applying and why
  • Permission from the landowner
  • Map showing exact burial location
  • Certificate of Title
  • Consent from anyone with an interest in the land

When Council Will Say No

If the land is inside a township
If there is risk to water supplies
If required consent is missing
If the location is unsuitable
If there would be more than one grave

If Your Application Is Approved

A funeral director must carry out the burial
You must follow all laws
The burial must be officially recorded
A legal agreement may be placed on the land title
