Rules for businesses wanting to set up outdoor dining areas on Council footpaths or public land.
⚠️ Important Disclaimer: I, Shane Grocke, am rewriting this policy in plain English so you can quickly understand what it is about and what conditions usually apply. This is a guide only — the official Council policy and any permit conditions are what you must rely on.
This policy explains how outdoor dining can be used on public roads and footpaths. It helps Council manage the needs of businesses, pedestrians, and road users in a safe way.
Council supports outdoor dining because it improves social and cultural life in the community. It also aims to improve how towns look and feel while keeping people safe.
Footpaths are mainly for walking, cycling, and small wheeled devices. Outdoor dining can be allowed where there is enough space.
You must get approval before using a public road or footpath for outdoor dining. This is called an Outdoor Dining Permit.
⚠️ Important: It is an offence to use a public road for business without approval.
You may also need development approval under the Planning, Development and Infrastructure Act 2016. You should check what approvals are needed before starting.
If your application is approved, your permit will include conditions. You must follow all permit conditions at all times.
Outdoor dining permits may include an annual fee set by Council.
If you have a complaint, you can send it in writing to the Chief Executive Officer.
This policy is reviewed every four years or sooner if required.
